Website Contract Agreement

Purpose: To provide to the purchaser with a website utilizing modern methods. This website will be used on the Internet for advertising, email, and for displaying graphics. Additional website features will be outlined in a separate paragraph of this contract.
Work Methods: Submission of digital images and photos are the sole responsibility of the purchaser. The website work will be basically completed utilizing PHP and HTML. The design, images, and all associated files will be sole property of the purchaser and will be recorded on CD by the contractor.
Submission of Content: All content of the website is the responsibility of the purchaser. When content is submitted, it is the responsibility of the purchaser to review such content for spelling and verbal accuracy. The purchaser is responsible for submitting all content in a timely manner (either digitally or in written, legible format) so that the contractor can complete all work as set forth in the Completion Date paragraph below.
Costs: The purchaser agrees to pay the sum of $500.00 for the work as outlined in the Work Methods paragraph. The purchaser also agrees to reimburse the contractor in full should unexpected expenses exceed the amount of $50.00. The purchaser also agrees to pay the contractor in advance in full should domain name and hosting costs exceed $75.00 for a multi-year period. Domain name and hosting expenses for greater periods of time than one year must be paid in full before work begins. If any extra work is required by the purchaser the prices for such features as requested will be added to the value of this contract. Domain and Hosting Renewal: If the contractor is placed in the position of purchasing the domain name and hosting for the purchaser, the purchaser will be billed 45 days prior to the month the hosting and domain name expire. This is to give the purchaser time to reconsider having additional time for a web presence and the contractor time to submit the renewal payment. Billing may be sent by postal service or email dependant upon the purchasers' location. The purchaser has 21 days after receiving a renewal notice to remit payment to the contractor or to notify the contractor that a web presence is no longer desired. If payment or notification to quit are not received in that 21 day period, the contractor will assume that a web presence is no longer desired and will not renew the domain name and hosting. Renewal payments must be made in full with either a postal money order or cash for the period of time web hosting and a domain name is desired.
Features: Each feature can have multiple instances where it is used and there will be a full charge for each instance.
Completion Date: The contractor will have completed this work by no later than
____/____/_20____ or when content
for the website has been fully submitted. Additional submissions of content will extend the completion date for 30 days per
submission (not to exceed 90 days and three additional submissions).
Method of Payment: The purchaser agrees to pay (by cash or postal money order (no checks)) the amount stated above for all work and to pay by cash or postal money order any excessive expenses for domain name or domain hosting when the contractor provides proof of purchase for those items as outlined in the Costs paragraph. Payment can be made in no more than two payments as follows:
- The first payment will be made at a point in time when (no later than 15 days after) a domain name, hosting and initial setup of a primary (index) page has been completed and approved by the purchaser. This payment is to be no less than half the amount agreed to for all work to be performed including any and all website features.
- The final payment shall be made in full no later than 60 days after the domain name is purchased and no later than 30 days after the first payment if the entire website content has not been submitted in it's entirety by the purchaser at the onset of this contract (whichever is the shortest length of time).
- Payment by postal money order must be made out to R C Burroughs.
Moral Decency: Submissions of text and/or digital media are restricted to guidelines that fit into the morals of today's legitimate society in the United States. Images and text that are negative in content towards any group of persons, women, or children, will not be used but rather turned over to the proper authorities who will most likely take steps to prosecute under the fullest extent of the law.
